Why This Matters Now

The Rules Are Moving. Your Practice Needs an Operating System.

The State Bar’s 2026 Practical Guidance is highly authoritative. Proposed amendments to Rules 1.1, 1.4, 1.6, 3.3, 5.1 and 5.3 would make selected AI-related duties enforceable through the existing disciplinary process. Most attorneys still lack a durable, documented way to meet these expectations.

01

Competence Is Non-Delegable

You must understand the tools you use and independently verify outputs. Judgment cannot be outsourced to a model.

02

Confidentiality Is the Highest-Stakes Duty

Inputting client data into AI systems creates new risk. Reasonable efforts and sanitization are now expected.

03

Hallucinations Reach Tribunals

Candor obligations apply to AI-assisted research and drafting. Verification protocols are no longer optional.

04

Supervision Extends to AI

Rules 5.1 and 5.3 treat AI systems as tools requiring managerial oversight and nonlawyer-assistant controls.

Five Sessions → One Operating System

What You Will Build

Each 90-minute session delivers a permanent piece of infrastructure. By Session 5 you leave with a documented personal or firm AI Operating System.

Session 01

Foundations of Ethical AI Use

Rule 1.1 · Competence · System Prompt

How LLMs actually work, the two duties of competence under the 2026 Guidance, risks of agentic systems, and a personal system prompt with ethical guardrails.

Session 02

Client Development & Communication

Rule 1.4 · Disclosure · Outreach

When AI use is “material,” disclosure language that works, and a complete AI-assisted prospect research + outreach sequence with verification checkpoints.

Session 03

Internal Workflows & Confidentiality

Rule 1.6 · Rule 5.3 · Sanitization

Reasonable efforts standard, practical input sanitization and redaction, treating AI as a nonlawyer assistant, and one fully protected recurring workflow.

Session 04

Research, Drafting & Candor

Rule 3.3 · Verification · Hallucination Control

Candor obligations for AI-assisted work product, a rigorous research → draft → verify pipeline, and a reusable citation verification checklist.

Session 05

Governance & Your AI Operating System

Rules 5.1 & 5.3 · Agentic Governance

Managerial and supervisory duties, basic firm or practice-level AI policies, governance for agentic systems, and the complete documented AI Operating System.

John Williams

Head of AI Enablement and Adoption · fxops.ai

John designs and implements practical AI operating systems for professional service providers. This course is deliberately non-advisory: it translates the State Bar’s published Practical Guidance and proposed amendments into usable workflows, system prompts, checklists, and policies.

The lawyer remains fully responsible for professional judgment and compliance. The facilitator’s role is enablement, not interpretation of the Rules for any specific matter.

Questions

Frequently Asked

Is this legal advice or an ethics opinion?
No. This is practical enablement training grounded in the State Bar of California’s published 2026 Practical Guidance and the six proposed Rule amendments. We do not provide legal advice, formal ethics opinions, or interpretations for any specific client or matter. The lawyer remains fully responsible for professional judgment and compliance. Confirm application to your circumstances with qualified counsel when needed.
Have the proposed Rule amendments been adopted?
As of the latest available information (July 2026), the formal Rule amendments have not been finally adopted by the California Supreme Court. They remain proposed. The Practical Guidance itself was approved by the Board of Trustees and is non-binding but highly authoritative. This course treats the Guidance as the primary practical source and the proposed amendments as the direction of formal enforceability.
Who is this course designed for?
California-licensed attorneys — particularly solo practitioners, small-firm lawyers, and practice leaders who want a durable, documented way to use generative and agentic AI while meeting the expectations in the Practical Guidance and the proposed Rules. The cohort is limited to 10 so every participant can receive meaningful interaction.
What if I miss a session?
Sessions are live and interactive. Materials and templates are provided, but the value of the cohort format is real-time discussion and workshopping. Please plan to attend all five Thursdays if you enroll.
Will I receive a certificate or CLE credit?
This is a practical enablement program focused on building an AI Operating System. It is not currently offered for MCLE credit. Participants leave with working artifacts rather than a certificate of attendance.
Can my firm send multiple attorneys?
Yes, subject to the 10-person cohort limit. For larger groups or a closed firm-only experience, use the “Request a Private Firm Cohort” option to discuss scheduling and pricing.
